Our firms represent all Retail Holders that fit the definition above, even if such persons have not formally retained either of our firms. Of course, any person that wants to retain their own lawyer can still do so. Important Facts and DatesErnst & Young Inc., (the Monitor) has determined that to successfully register for the CCAA restructuring vote, you must printout, complete, sign and fax the Court Approved form entitled 'ABCP Voter Identification Form' to E and Y no later than 5:00 PM (Toronto Time) on April 22, 2008. The Ernst & Young fax number is 416-943-2850 and the telephone number [for assistance] is 1-888-373-6213. If you do not have a fax machine, the only recommendation we can make is that if you can access a friend’s, failing which you will have to access a commercial service in your own community, such as Kinko’s, UPS, Mac’s Milk, etc. If you want Juroviesky and Ricci LLP to vote on the Plan on your behalf, you must printout, complete, and sign the Court Approved form entitled 'ABCP Form of Proxy' and return the form to E and Y no later than 5:00 PM (Toronto Time) on the last business day before the meeting. Note that no ‘Form of Proxy’ form is required if you plan on voting yourself (in person) at the meeting, unless the notes are not held in your (the individual noteholders’) own name. For example, if the notes are held in the name of an entity (i.e., corporation, partnership or trust), the entity needs to fill in the ‘Form of Proxy’ naming the person (present at the meeting) as the authorized voting person in order for that person to be recognized at the meeting for voting purposes. The CCAA meeting is currently scheduled to be held on April 25, 2008 at 10:00 AM at the Fairmont Royal York, 100 Front Street West, in Toronto, Ontario. (Please note that there is an outstanding motion before the Ontario court to extend the meeting date. The motion is scheduled to be argued on Tuesday morning, April 22, 2008. We are unable to make any comment as to the outcome of this specific hearing relating to the request for an extension date.)
